HOW HIGH? INSURANCE AND MEDICAL MARIJUANA IN 2017

Location: Garden I

This CLE session focuses on the impact of medical marijuana on insurance coverages and underwriting. Part one of the program begins by defining common terms of art used in the medical marijuana industry, and providing a brief history of criminal laws on controlled substances and the movement towards legalization. Part two of the program discusses past legislation decriminalizing medical marijuana and expectations regarding 2017 and beyond. Part three details the impact of legalized marijuana on various lines of insurance coverage and compares and contrasts insurance coverage for legalized marijuana with other highly regulated substances such as alcohol and tobacco. Part four of the program concludes with a discussion of ethical obligations and pitfalls attorneys and insurance professionals may face when advising their clients on this emerging industry, including a survey of how various state bars have handled this issue.

Introducing MCCA’s Sources of Success™ Program, a professional development program specifically tailored for junior and mid-level attorneys from corporate legal departments and law firms. Learn successful career strategies, develop your professional network, apply it to your career and move from a benchwarmer to a starter! Sources of Success Part 1 will be divided into 2 components. The first half of the session will be led by Michelle Banks, former Executive Vice President and Global General Counsel for Gap Inc., and Charles H. Wilson, Vice Chair, Office Managing Partner of Cozen O’Connor. They will provide attendees with valuable insight on what they look for when reviewing resumes and interviewing top talent for their organizations; the different skill sets that a candidate should highlight for an in-house position vs. a law firm; and how to make yourself stand out on a deep bench. Part 2 will consist of a resume and mock interview clinic. Corporate Social Responsibility (CSR) efforts in the environmental space have focused mostly on environmental sustainability. However, the public’s exposure to a company’s environmental risk profile is much broader than that. Many companies have been driven into bankruptcy by the weight of various environmental liabilities, and when that happens, the public invariably ends up sharing the burden of those liabilities. Being prepared to respond effectively in emergency situations is crucial for companies, but engaging in proactive efforts to prevent environmental liabilities from emerging in the first place is typically a far more cost-effective approach. This CLE focuses on how companies can use the environmental diligence process typically reserved for transactions (where an acquiror or investor seeks to assess and mitigate the environmental risk and liabilities associated with a target company or business) as a CSR benchmark to signal a proactive and holistic approach to managing one’s environmental liabilities.

EEOC YOU SOON? UNDER INVESTIGATION BY THE EEOC: PREVENTION AND DEFENSE STRATEGIES TO AVOID CLAIMS OF SYSTEMIC DISCRIMINATION

In 2016, the EEOC trumpeted the success of its systemic program and remarked upon a five-year, 250% increase in the number of systemic investigations over the past five years. Moreover, the EEOC claims a 94% success rate in systemic discrimination litigations over the past ten years. In the wake of the $190 million-dollar enforcement action against Wells Fargo and other recent government enforcement actions, incentive compensation, product cross-selling, and sales practices are facing unprecedented scrutiny. In addition, a growing list of government regulators are evaluating practices, issuing guidance, and commencing expansive reviews and other regulatory inquiries. The It Factor – Making It Happen

From Cost Center to Revenue Generator – a New Approach for In-House Legal Departments

As in-house legal departments continue to face budget pressures, this CLE offers attendees a pathway to “do more with less,” through a revenue recovery program, a structured process through which in-house counsel, in conjunction with their business unit clients, examine company’s contracts, operations, insurance policies and other transactions and deals to identify legitimate claims and recoveries that already exist. CANCELLATIONS & SUBSTITUTIONS:

All cancellations must be received in writing; telephone cancellations will not be accepted. Cancellations received in writing before March 19, 2017 will be fully refunded minus a $65.00 administrative fee. Individuals canceling in writing after March 19 but prior to April 18 will receive a full credit towards attendance to MCCA’s 2018 General Counsel Summit (only monies paid for the 2017 GCS will be credited; after applying credit, any balance due is the responsibility of the registrant). If written confirmation of cancellation is not received by April 18, no refunds or credits will be issued of any kind. Credits will be processed after the conference. FINANCIAL HARDSHIP POLICY:

MCCA, at its discretion, may reduce or waive the conference fee for any attorney, member or non-member, who wishes to attend the conference, but for whom the cost would be a financial hardship. Requests for tuition waiver will not be accepted on-site.
