2022 Pitch Session Network
MCCA hosted the Sixth Annual Pitch Session Network (“PSN”) at the 2022 Creating Pathways to Diversity® Conference on October 17-19, 2022. PSN allows in-house counsel to connect with diverse law firm partners at majority law firms, diversify their preferred provider portfolios and hold law firms accountable for their diversity efforts. PSN provides a platform for diverse law firm partners and legal service providers to meet privately, make meaningful connections, and build lasting business relationships with corporate legal departments interested in legal services.
2022 PSN Corporate Participants
Eligibility Criteria for PSN Participants:
ALL PSN participants MUST be a confirmed registrant of the 2022 Pathways Conference prior to the application being considered. There is no additional cost to participate.
- Corporate Legal Departments:
- In-house counsel MUST have the authority to hire outside counsel directly; but
- In-house counsel do not have to be members (however, members receive preference in the matching/selection process).
- Law Firms:
- Law firm participant MUST be MCCA members (or pre-approved affinity organizations) and CANNOT participate solely as a conference sponsor (non-MCCA member attorneys MUST provide a verification of good standing from the affiliate bar association prior to application being considered);
- Law firm participant MUST complete the PSN application (which is found in the conference registration);
- Law firm participant MUST be a DIVERSE PARTNER (MCCA’s definition of diversity includes gender, race/ethnicity, LGBTQ+, veterans/service members and attorneys with disabilities);
- Law firm participant MUST provide their attorney profile and/or resume to complete their PSN application; and
- Law firm participant MUST provide a profile of their firm to complete their PSN application.
- Legal Service Providers (non-law firms):
- Legal service providers MUST be 2022 Pathways Conference sponsors to participate in the Pitch Session Network; and
- Legal service providers MUST provide their profile to complete their PSN application.

MCCA’S BLUEPRINT WORKSHOP FOR SELLING & BUYING – A PITCH WORKSHOP FOR OUTSIDE COUNSEL
Through instruction and experiential learning, participants will work together to learn skills and behaviors for building successful business relationships. Outside counsel will have the opportunity to work in teams to develop a formal pitch from a mock RFP for legal services, which will be presented to senior in-house counsel.
This workshop is open to law firm members only and has max capacity of 30 participants. Preference will be given to law firm partners; associates are welcome to apply if their firm is a two tier partner system. In-house members who would like to serve as workshop coaches, assisting law firm participants with their pitches and sharing best practices, are invited to email Sophia Piliouras at spiliouras@mcca.com.
Non-members will be placed on a waiting list as will any other participants once we reach max capacity. Black Lives Matter. Trade policy. Immigration. Over the last four years, companies have been under pressure from their constituencies — employees, customers, investors, and the communities in which they operate — to take a public stand on high-profile political and social movements. According to research from the Edelman Trust Barometer, 54% of employees globally believe that CEOs should speak publicly on controversial political and social issues they care about. Similarly, 53% of consumers agree that every brand has a responsibility to get involved in at least one social issue that does not directly impact its business.

We all want to be seen in an unbiased way. We do not want stereotypes, prejudices, or preconceptions to distort other people’s perceptions of our capacities, capabilities and potentials. White Women Advocates - The Intersectionality of Inequality
As with all organizational imperatives, the fight to end systemic racism needs to be led from the top and be informed by all employees, especially women of color who have been historically and systematically marginalized. It will discuss on how data is key in creating sustainable systemic change (internally and externally). Companies spend billions of dollars annually on diversity, equity, and inclusion efforts, but the results are slow.
In the last few years, women’s voices have been crucial. From the #MeToo movement to the women’s marches to the historic wins in 2018 elections to being on the front lines combating COVID-19, women are speaking out and engaging in the world in positive new ways. However, the issues are very complicated in creating real change. White women must address how they perpetuate the systems that block women and people of color from having real power. Being let into the white man’s world without changing any of the underlying rules of how it operates will result in the same thing: power systems that default to white male leadership and keep systemic racism and sexism in place.
The panel discussion will revolve around how white women can be better advocates to women of color and create real change in corporate America.

Companies “Value” DEI, but Are They Investing at the Right Levels to Drive Change?

Corporate attempts to improve diversity, equity and inclusion (DE&I) are falling short, according to new research that raises serious doubts about traditional approaches to the business and social issues surrounding DE&I.
A recent case suggests company diversity, equity and inclusion policies can’t be thought of as add-ons but must be built into the leadership structure. A settlement earlier this year between Pinterest and a class of its investors might serve as a wake-up call to general counsel whose company treats their diversity, equity and inclusion (DEI) policies as window dressing. The agreement, still preliminary but expected to be finalized, connects a company’s DEI policies to the fiduciary responsibilities of the management team and directors.
This panel will discuss how to successfully foster DE&I focus on making systemic changes, advance DEI and embed in the fiduciary duties of leaders and operating DE&I “as a business function, not a set of HR initiatives, with a well-defined strategy that is owned by everybody in the organization and supported by capable subject matter experts.

Since 1999, MCCA began tracking information about Fortune 500 general counsel and more broadly Fortune 1000 since 2004. Despite the ongoing pandemic into 2021, we saw little movement within the Fortune 1000 general counsels and in some areas a net loss in representation.
There is still a long way to go before Fortune 1000 GCs are representative of the US population. The rate of change will increase only if female and minority GCs are promoted more often at the highest levels. This means that representation must also increase within the active attorney population. As previous survey editions have shown, once a female or minority candidate is awarded a GC position, the pool from which their successor is drawn becomes more diverse as well.
The panel will discuss the 2022 MCCA report, the key factors to sustaining focus and creating models to carry this focus forward and strategies on how to increase representation at the top in the legal profession.

A great deal has been written about the pathways and barriers to women’s advancement into leadership positions. Concepts such as the glass ceiling, concrete walls, sticky floors and career labyrinths have received significant attention in research and popular media.
Another potential obstacle for this new wave of women in leadership roles is the danger of the “glass cliff.” This phenomenon happens when women achieve leadership roles during periods of downturn, crisis, conflict or failure within the organization. These are high-risk leadership assignments for which women and diverse leaders may take the blame if the organization or situation does not rapidly improve under their leadership. So, women may break through the glass ceiling to reach top leadership roles, only to fall off of the glass cliff if the organization does not recover from the problems they inherited. The existence of the glass cliff is confirmed by research that women and people of color are more likely to be promoted to CEO of weak performing or troubled firms.

Racist Robots: Embedded Racism in Facial Recognition Software
Companies have been pouring billions of dollars into developing more robots to help replace humans for tasks such as stocking shelves, delivering goods or even caring for hospital patients. Heightened by the pandemic and a resulting labor shortage, experts describe the current atmosphere for robotics as something of a gold rush. But tech ethicists and researchers are warning that the quick adoption of the new technology could result in unforeseen consequences down the road as the technology becomes more advanced and ubiquitous.
In the past two years, more than 200 class actions have been filed in Illinois, and that number will grow in response to this ruling. As companies integrate this type of emerging technology into their businesses, they need counsel who can help them navigate this new landscape.

Generational Inequities in Corporate America
The most successful companies also tend to be the most diverse. But while we typically associate diversity in professional settings with gender and racial differences, this dedication to diversity should also include age. Generational diversity refers to having a vast range of ages represented in the workplace.
Now more than ever, workplaces are reckoning with the concept of generational diversity. Part of this is because there are more people over the age of 60 than under the age of 15 in Europe and North America for the first time in history. At this rate, more than half of the population in Western Europe will be over the age of 50 by 2030.

The Harvard Case, the Future of Race-Conscious Admissions and Impact on the Pipeline
Harvard’s and UNC’s race-conscious admissions policies have been in the spotlight since Students for Fair Admissions (“SFFA”) sued both institutions in 2014, alleging that they violated the Supreme Court’s precedents governing the permissible consideration of race in college admissions. Harvard and UNC prevailed in the lower courts, but the cases have now reached the Supreme Court, where they will be argued on October 31, 2022. The Supreme Court will consider not only whether Harvard and UNC’s admissions processes comply with its longstanding admissions precedents but also whether those precedents should be revisited.
Experts on the subject will discuss the cases’ backgrounds, key issues, and potential implications.

Gueter Aurelien’s practice focuses on a broad range of corporate law matters, including mergers and acquisitions, corporate governance, commercial financing, equity investments, securities offerings, commercial contracts, and general business transactions. Gueter advises start-up, emerging growth, and later-stage companies in a variety of industries; financial institutions; specialty lenders; banks; investors; entrepreneurs; and nonprofit organizations. As a good neighbor, John is an active participant in State Farm’s pro bono program and collaborates with state-wide and local providers. Michelle grew up in Utah, moving to Salt Lake City from Los Angeles at the age of five. After receiving her bachelor’s degree in Computer Science from Northwestern University and her law degree from Vanderbilt University, Michelle began her legal career as a federal judicial clerk in the District of New Mexico and then later in the Middle District of Tennessee. After clerking, Michelle worked for several national law firms with a focus on intellectual property law, including patent prosecution and copyrights. Her experience living and working around the country (as well as a summer spent living in Venezuela and in New York City) allowed Michelle to see many different perspectives and helped her develop communication skills that she has integrated into her practice. Rodney C. Pratt has over 20 years of experience and success leading global retail organizations as a trusted and strategic business executive and legal advisor. Rodney currently serves as the Senior Vice President and Chief Legal Officer of LVMH Moët Hennessy Louis Vuitton Inc., the North America subsidiary of the French multinational conglomerate and world leader in luxury products and services. Rodney oversees the North American business, leads the LVMH North America legal team, and serves on the LVMH North America Executive Leadership Team. In his role, Rodney is responsible for strategic, tactical, and operational execution and oversight on the entire range of legal matters that typically confront a business unit within a major global consumer company. Rodney also supports LVMH Maisons, providing proactive and pragmatic legal counsel regarding worldwide regulatory, corporate, litigation and commercial matters.
Prior to joining LVMH, Rodney spent over 11 years at NIKE, Inc. While at NIKE, Rodney served for over six years as General Counsel of Converse Inc., a wholly owned NIKE subsidiary. Originally from Ann Arbor, Michigan, Rachael studied mechanical engineering at the University of Michigan and attended law school at University of Houston while working as a patent agent for Shell Oil Company. After law school, she spent time working abroad in the Netherlands as a lawyer for the Shell IP department.
In 2012, she joined Microsoft as a licensing attorney in the OEM business and a product attorney supporting a variety of hardware projects including the Microsoft HoloLens, Microsoft Health, and the Microsoft Band. Rachael continued counseling clients developing new form factor devices at Google, where she was the lawyer for the Daydream AR/VR business. After a few years counseling in the AR/VR space, Rachael moved to the Payments legal team where she currently leads the product counsel team supporting Google Wallet.
During her free time, Rachael dabbles in video editing, practices yoga, and volunteers as a member of the legal committee for the Organization for Transformative Works. Her claim to fame: winning an international scavenger hunt known as GISHWHES with her awesome team known as the Vatican Cameos.
